Conflicto de competencia entre el Juzgado Primero Civil Municipal de Tunja y el Juzgado Cincuenta Civil Municipal de Bogotá.

La Corte reitera que los jueces o tribunales deben respetar la elección que haya efectuado el accionante, en razón a que su libertad merece protección por parte del ordenamiento jurídico, siempre que se encuentre ajustada a los parámetros de competencia establecidos.

En este caso la Sala Plena dispone la devolución del expediente a quien primeramente conoció del mismo, es decir al Juzgado Primero Civil Municipal de Tunja, para que resuelva sobre el amparo solicitado a "prevención", sin dilación alguna.
